1. Warranty Coverage

Sprague Floor Covering guarantees that all labor associated with the installation of commercial flooring is performed to the highest industry standards. We warrant that our workmanship will remain free from installation-related defects forever, subject to the terms and conditions outlined in this document.

This warranty covers:

• Proper installation techniques ensuring flooring remains securely adhered.
• Prevention of issues caused by improper seam sealing, adhesive application, and subfloor preparation.
• Repairs to defects caused solely by installation errors.

2. Exclusions

This warranty does not cover:

• Material defects in the flooring product itself (which are covered by the manufacturer’s warranty).
• Damage due to improper maintenance, accidents, misuse, abuse, or neglect.
• Subfloor movement, moisture intrusion, or structural changes beyond our control.
• Normal wear and tear, including scratches, dents, fading, or discoloration.
• Repairs or alterations made by parties other than Sprague Floor Covering.

3. Warranty Claims Process

To initiate a warranty claim, the customer must:

1. Provide written notice of the issue to Sprague Floor Covering within 30 days of discovering the defect.
2. Include proof of purchase and installation documentation.
3. Allow an inspection by our technicians to assess the claim.

If a valid labor-related defect is found, we will, at our discretion, repair or reinstall the affected flooring at no cost to the customer.

4. Limitations of Liability

This warranty is limited to the original purchaser and is non-transferable. It applies only to the specific commercial property where the flooring was originally installed. This warranty applies only to direct-to-end-user work and does not cover installations performed through a general contractor. Sprague Floor Covering is not liable for any indirect, incidental, or consequential damages arising from installation-related defects.

5. Approved Flooring Manufacturers

This warranty applies exclusively to installations using flooring materials from the following manufacturers:

• American Olean
• Altro (wall products only)
• Armstrong
• Crossville
• Daltile
• Gerflor
• Interface
• J+J Flooring
• Mannington Mills
• Matter Surfaces (Mats Inc.)
• Nora Systems
• Roppe

Installations using products from manufacturers not listed above are excluded from this labor warranty. For a comprehensive list of approved manufacturers or to verify if a specific product is covered, please contact Sprague Floor Covering.

6. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to this warranty, the parties agree to the following process:

1. Negotiation: The parties shall first attempt in good faith to resolve any dispute through direct negotiation.
2. Mediation: If the dispute cannot be resolved through negotiation within 30 days, either party may initiate mediation. The mediation shall be conducted in Dover, NH, administered by a mutually agreed-upon mediator. The costs of mediation shall be shared equally between the parties.
3. Arbitration: If the dispute is not resolved through mediation within 60 days of initiation, the dispute shall be settled by binding arbitration in accordance with the rules of New Hampshire Office of Mediation and Arbitration. The arbitration shall be conducted in Dover, NH. The arbitrator’s decision shall be final and binding, and judgment may be entered in any court having jurisdiction.
4. Costs: Each party shall bear its own costs and expenses related to the dispute resolution process. The costs of the mediator and arbitrator shall be shared equally unless the arbitrator determines otherwise in the final award.

7. Governing Law

This warranty shall be governed by the laws of New Hampshire, and any disputes shall be resolved in the jurisdiction of Dover, NH.
